The Fair Work Ombudsman has flexed again
The Fair Work Ombudsman has flexed again, using the franchisor liability provisions in the Fair Work Act! Read the FWO media release here.
This time, Bakers Delight is in the limelight, with Bakers Delight Holdings potentially on the hook for a portion of staff underpayments at three stores in Hobart.
In a nutshell – the Ombudsman alleges that the franchisor knew about the underpayments but didn’t do enough to correct it.
The point here for franchisors?… Franchisors simply need to stay on top of fair work rules and act promptly when there’s a problem.
If you have a team or an audit process to monitor fair work compliance – great 👏 – you’re on the ball. Now just ensure there’s a solid roadmap to follow if a franchisee fails to correct shortfalls (and get rid of any ‘too hard basket’).
